Breathe. Byron Bay – Red Light Therapy Membership Agreement
4.1 Membership & Services
This Agreement entitles the member to 2 full-body Red Light Therapy (RLT) bed sessions per week at Breathe. Byron Bay. Sessions are non-transferable and any unused weekly sessions do not roll over into future weeks unless otherwise agreed in writing by Breathe. Byron Bay.
4.2 Fees & Payment
The weekly membership fee is $59.00 AUD (inclusive of GST), charged weekly to the member's nominated credit or debit card. All prices include GST in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Breathe. Byron Bay may adjust membership fees by providing at least 30 days' written notice.
4.3 Minimum Commitment
Membership requires a minimum commitment of 8 weeks from commencement. Weekly fees remain payable throughout the minimum term regardless of attendance, except where early termination is permitted under Clause 4.6.
4.4 Automatic Continuation
After the initial 8 week commitment, membership automatically continues on a week-to-week basis at the same weekly fee until cancelled in accordance with Clause 4.5.
4.5 Cancellation
After the minimum term:
- Members may cancel by providing 4 weeks' written notice via email to info@breathestudios.com.au or in writing at the studio.
- Membership remains active during the notice period and weekly fees continue to apply.
During the minimum term:
Cancellation is not permitted except under Clause 4.6. Early termination fees equal to the outstanding weeks of the minimum term may apply.
4.6 Exceptional Termination
Members may terminate without penalty during the minimum term where supported by documentation if:
- Serious illness or injury prevents participation (medical certificate required).
- Permanent relocation more than 50 km from the studio.
- Breathe. Byron Bay materially changes or ceases Red Light Therapy services.
4.7 Membership Suspension / Freeze
Members may request a suspension of up to 4 weeks per calendar year with at least 5 business days' written notice. Membership payments pause during the freeze, while the minimum commitment is extended by the same period. Additional freeze periods may be available at the studio's discretion.
4.8 Cooling-Off Period
Members have a 7-business-day cooling-off period commencing from the signing date. Cancellation during this period will receive a full refund, less any reasonable administration fee where sessions have already been used, in accordance with Australian Consumer Law.
4.9 Liability Waiver & Assumption of Risk
Members acknowledge that participation in Red Light Therapy involves inherent risks including eye sensitivity, skin reactions and interactions with medications or medical conditions. Participation is entirely voluntary and at the member's own risk. To the fullest extent permitted by law, Cell Regen Pty Ltd (trading as Breathe. Byron Bay), its directors, employees and contractors are not liable for injury, loss or damage except where liability cannot legally be excluded under the Australian Consumer Law.
4.10 Australian Consumer Law
Services are provided with guarantees that cannot be excluded under the Australian Consumer Law. Members are entitled to refunds or replacements for major failures and compensation for reasonably foreseeable loss or damage. Nothing in this Agreement limits consumer rights under Australian law.
4.11 Privacy
Personal and health information is collected solely to administer memberships and ensure member safety. Information is managed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Information will only be disclosed where required for payment processing, service delivery or by law.
4.12 Studio Rules & Conduct
Members must:
- Arrive on time for booked sessions.
- Remove jewellery and eye make-up before entering the RLT bed.
- Wear protective eyewear throughout every session.
- Cancel bookings at least 12 hours before the session.
- Follow all staff safety instructions.
Breathe. Byron Bay reserves the right to suspend or terminate membership immediately, without refund, where unsafe, disrespectful or unlawful conduct occurs.
4.13 Amendments
Breathe. Byron Bay may amend these Terms by providing at least 30 days' written notice. Members who do not accept the amendments may cancel during the notice period without penalty, provided the minimum commitment has been fulfilled.
4.14 Governing Law. This Agreement is governed by the laws of New South Wales, Australia. Any unresolved disputes will be referred to the NSW Civil and Administrative Tribunal (NCAT) or another mutually agreed dispute resolution forum.
